Loder, a longtime face of MTV News, made the controversial statement on the “Jeff and Jeremy in the Morning” radio show on Tuesday, November 8 morning.

The best solution, however, is the one Lisa Brown urged: State legislatures ought to address the gap in the law regarding the reputations of the dead. Rhode Island has a law to this effect, albeit a very limited one. And many civil law jurisdictions -- Quebec is one example -- allow such actions.
Some may respond that this would "chill" freedom of speech under the First Amendment. No more so, however, than for the living.
Moreover, unlike the living, the dead have lost the power of counterspeech -- the power to respond. The underlying philosophy of the First Amendment is that there must be a open marketplace of ideas, where the truth will emerge from "uninhibited, robust, and wide-open" debate. But the dead are not in a very good position to participate.

GRAND RAPIDS, Mich. (RNS) The anti-gay Westboro Baptist Church has announced plans to picket this week's funeral services for former first lady Betty Ford in California and Michigan.

The website of the Topeka, Kansas-based church said the fringe group will demonstrate at Ford's funerals because she divorced her first husband William Warren prior to marrying the late president Gerald R. Ford.

Early Probe Cleared Michael Jackson

DECEMBER 9--A confidential investigation by Los Angeles police and child welfare officials concluded earlier this year that allegations Michael Jackson sexually abused a cancer-stricken boy were "unfounded," according to an internal government memo obtained by The Smoking Gun.
The probe's findings were based, in large part, on interviews with the alleged victim, his two siblings, and the boy's mother. According to the memo, when the child was questioned in February by a social worker assigned to the Sensitive Case Unit of L.A.'s Department of Children & Family Services (DCFS), he "denied any form of sexual abuse" by Jackson and said that he never "slept in the same bed as the entertainer." While not specifically named in the DCFS memo, the 45-year-old Jackson is referred to repeatedly as "the entertainer."
The memo notes that the boy, now 14, and his 12-year-old brother--who also denied sexual abuse--expressed "a fondness for the entertainer and stated they enjoyed visiting his home, where they would often ride in the park, play video games, and watch movies." The pair's sister, now 17, told a social worker that she accompanied the boys on "sleepovers at the entertainers home," but had "never seen anything sexually inappropriate between her brothers and the entertainer."
The children's mother told investigators that Jackson was "like a father to the children and a part of her family." While acknowledging that her son "has slept in the same room as the entertainer," the woman claimed "they did not share a bed. The entertainer would sleep on the floor," according to the November 26 memo.
The joint probe by DCFS and the Los Angeles Police Department ran from February 14-27 and, the memo states, the "investigation by the Sensitive Case Unit concluded the allegations of neglect and sexual abuse to be unfounded both by the LAPD-Wilshire Division and the Department."
When an investigation is closed, child welfare officials can summarize their findings in one of three ways. If evidence is found to support abuse charges, the case is marked "substantiated." A case is termed "not substantiated" when evidence discovered is not sufficient to support allegations (though the charges may, in fact, be true). Finally, a matter is branded "unfounded" when officials determine there is no merit to the allegations.
As with many DCFS investigations, the Jackson abuse case began with a call to the agency's child abuse hotline. According to the memo, a "Child Abuse Referral" was phoned in on February 14 by a "school official" from the Los Angeles Unified School District, which oversees the city's sprawling public school system. Citing the prior week's ABC broadcast of "Living with Michael Jackson," the controversial Martin Bashir documentary, the school official lodged allegations of "general neglect by mother and sexual abuse by 'an entertainer,'" according to the summary memo. The school official identified both the cancer patient, then 13, and his younger brother as the "referred children."
While the school official is not further identified in the DCFS memo, published reports have indicated that the older boy was taunted by classmates after the documentary aired on ABC's "20/20" newsmagazine. During the February 6 program, the child was seen holding hands with Jackson and resting his head against the singer's shoulder. Jackson told Bashir that he had slept with many children unrelated to him, but insisted, "It's not sexual, we're going to sleep. I tuck them in...It's very charming, it's very sweet."
In a clear reference to fallout from the Bashir documentary, the boy's mother told investigators that "she believed the media had taken everything out of context," according to the memo, which summarizes the DCFS child abuse investigation. The "sensitive case" memo was prepared at the direction of Dr. Charles Sophy, a high-ranking DCFS official who joined the department in late-March, a month after the Jackson probe was completed. The memo was authored by Jennifer Hottenroth, a DCFS assistant regional administrator. In a brief telephone interview yesterday morning, Hottenroth declined to speak about her memo, saying, "I can't talk about it...I can refer you to our public affairs person. I can't comment on any of this." Sophy (pictured at right) did not return a message left with his assistant. Louise Grasmehr, a DCFS spokesperson, said that while she had been given a copy of the document by Hottenroth Monday morning, "We cannot comment on anything that is stated in the memo. Because it's all protected under confidentiality laws in California."
The boy's February 2003 interview with child abuse investigators--not to mention those with his family--appears to run counter to allegations he later made to law enforcement officials in Santa Barbara, where Jackson was arrested November 20 and released on $3 million bail. District Attorney Thomas Sneddon has said that he expects to file felony child molestation charges against Jackson next week. In addition to the boy's original denial of sexual abuse by Jackson, his younger brother's February 2003 statements also appear to contradict recent published reports claiming that the child has told Santa Barbara investigators that he witnessed his brother being molested by the star.
While it is unclear what, if any, effect the LAPD-DCFS investigation will have on a future Jackson prosecution, the performer's defense team will surely seize on the February 2003 probe's findings to question the current veracity and motives of the child and his family--and, of course, further muddy a case that already promises to be a difficult prosecution.
The child abuse investigation was immediately placed with the Sensitive Case Unit since department guidelines dictate that if "one of the clients in the referral is a public figure" or if the case's allegations "would be certain to generate media interest if they became known outside of DCFS," the matter requires utmost secrecy.
As with most DCFS abuse cases, a children's social worker (CSW) was dispatched to interview the boys, as was a LAPD investigator (the memo does not indicate whether the cop and the social worker conducted their interviews in tandem). In either case, it is likely that the children were questioned apart from their mother, since the abuse referral included allegations of neglect on the woman's part, according to a DCFS source familiar with agency operations.
The allegations examined this year in the LAPD-DCFS probe mirror sex abuse claims that surfaced in 1993, when a 13-year-old California boy claimed that the pop star molested him. Jackson, who was not charged in that case, reportedly made a multimillion dollar payment to settle a civil suit brought by the child and his family. Despite the fact that Michael Jackson was under investigation for more or less 10 years for improper conduct around minors, there was never any truth to the allegations, it has now emerged. Moreover, authorities had zero evidence to support his accusers’ claims.

Starting with 1993, as any Michael Jackson fan must know, the singer’s life was turned upside down by allegations of improper conduct.

He settled the first case outside the court which, his mother Katherine said on Today the other day, he did not want because he knew that would make him appear guilty.

Now, a source familiar with the investigations is telling Radar Online that authorities never had a shred of evidence to back up the claims made by his accusers throughout the years.

In other words, Michael Jackson has been vilified for no reason at all.

“The Los Angeles Department of Children and Family Services absolutely agrees with Katherine that her son never molested any child in cases the department investigated,” the source says.

The admission comes one day after Katherine Jackson’s interview with Matt Lauer for Today, in which she said the biggest misconception about her son had been that he was a molester.

It ruined his career and, ultimately, his life, even though he tried his best to work with the authorities to prove that the allegations made against him were false.

“Michael was fully cooperative during all of his interactions with DCFS. Michael was interviewed for hours without his lawyer. He held nothing back. He couldn’t understand why these allegations were being made against him. DCFS cleared him on any wrongdoing in ALL investigations,” the insider explains for Radar.

On the other hand, Michael did put himself in situations that left room for interpretations – but only because he was a child at heart himself, he never meant any harm.

“Did Michael put himself in precarious situations that most normal people wouldn’t? Absolutely... The questioning was very, very hard on Michael, he just couldn’t fathom that anyone could accuse him of being a child molester,” says the tipster.

Moreover, the accuser that stepped forward with his story in 2005 wasn’t even credible, the source adds.

With Katherine Jackson ratcheting up the debate about her son Michael Jackson's relationship with children by saying he was no child molester, a well-placed government source tells RadarOnline she's right.

"The Los Angeles Department of Children and Family Services absolutely agrees with Katherine that her son never molested any child in cases the department investigated," a source told RadarOnline.


Michael Jackson was investigated by DCFS on and off for at least 10 years. The department undertook a first extensive investigation of allegations made by an underage accuser in 1993.


"Michael was fully cooperative during all of his interactions with DCFS," the source said. "Michael was interviewed for hours without his lawyer. He held nothing back. He couldn't understand why these allegations were being made against him. DCFS cleared him on any wrongdoing in ALL investigations.

Hackney music studio The Premises has been on the receiving end of ‘hate mail’ after they installed a Michael Jackson sculpture.



The controversial artwork – called Madonna and Child – depicts the moment in Berlin in 2002 when the King of Pop held his baby out of a window. True to the original incident, the life-size statue leans out of the building.


Now the Premises Studios has become the target of abusive emails from Jackson fans, who say the sculpture is an insult to their hero.

One described it as: “The most outrageous sick thing that could have ever gone on in the city of London.”

Viv Broughton, Chief Executive of the Premises Studios, insisted that the artwork would not be taken down: “The sculpture recreates a moment of high drama in music history. The fans turned him into a deity and he in turn offered them his son. Lots of people have come here to view it. Most people think it’s brilliant.”

As regular visitors here may have already noticed, there is a new sculpture suspended twenty feet up on the side of our building. It’s a life-sized depiction of the moment in Berlin in 2002, when Michael Jackson dangled his baby out of the window. Intriguingly, it’s called Madonna and Child and it’s been installed in our office window. Swedish-born sculptor Maria von Köhler spent six months, first modelling it in clay then, from a plaster mould, it was cast in polyester resin and finished in acrylic and wax.

Various Jackson ‘fan-sites’ are already orchestrating a hate campaign against us (see blog comments below) thus illustrating the point that the sculpture is really about fan worship, about treating a singer like a deity.

Maria von Köhler has exhibited widely since she graduated with an MA from the Royal Academy Schools, Royal Academy of Arts in London in 2003. Her work is housed in collections worldwide, including The Zabludowicz Collection and The David Roberts Art Foundation, London. Von Köhler has held solo exhibitions at Seventeen, IMT and The Kiosk Project, London, as well as Seeline Gallery, Los Angeles and Galerie Lieser, Berlin. Other exhibition highlights include: When We Build Let Us Think We Build Forever, BALTIC, Gateshead; Larry’s Cocktails, Gagosian Gallery, London; National Geographic, Faggionato Fine Art, London; RightOn/Write Off, Chapman Fine Arts, London; Fresh, MOCA, Los Angeles; Selected Sculpture, Max Wigram Gallery, London.
